Özet
Bu çalışmanın amacı, Klasik Avrupa modelinde negatif kanun koyucu olarak kurgulanan Türk Anayasa Mahkemesi’nin pozitif kanun koyucu rolüne evrilmesini incelemek ve bu dönüşümün hukuki sonuçlarını ortaya koymaktır. Bu doğrultuda, anayasa mahkemelerinin dünyada ve ülkemizde hangi amaçlarla kurulduğu ele alınmaktadır. Negatif ve pozitif kanun koyucu işlevleri doktrindeki görüşler çerçevesinde açıklanarak ülkemizde Anayasa Mahkemesi’nin hangi rolü üstlendiği incelenmektedir. Bu bağlamda Mahkemenin yasama erkine dolaylı müdahale niteliği taşıyan kararları tahlil edilerek pozitif kanun koyucuya evrimin hukuki neticeleri tartışılmaktadır.
Anayasa mahkemelerinin kuruluş gayesi ve varlık nedeni temelde normların anayasaya uygunluğunu denetlemektir. Böylece çoğunlukçu demokrasi anlayışının yol açacağı kötü neticelerin önlenmesi amaçlanmaktadır. Anayasa mahkemeleri, bu denetim neticesinde kanunları iptal edebildiği için negatif kanun koyucu statüsüne kavuşmuştur. Ülkemizde Anayasa Mahkemesi kurulurken ise normları iptal etmek yanında siyasi otoriteyi sistemin geleceğini korumak için kısıtlama şeklinde zımni bir amaç da benimsenmiştir. Bu doğrultuda Anayasa Mahkemesi’nin bazı kararları, negatif kanun koyucudan pozitif kanun koyucuya bir sapma olduğu tartışmalarına sebebiyet vermiştir.
The aim of this paper is twofold. First, it examines the evolution of the Turkish Constitutional Court, which was originally conceived as a negative legislator within the Classical European model, into a positive legislator. Second, it explores the legal implications of this transformation. To that end, the paper discusses the rationale behind the establishment of constitutional courts both globally and in Türkiye. It then outlines the doctrinal debates surrounding the concept of negative legislator. By doing so, it evaluates the role of the Turkish Constitutional Court. Finally, it analyses the Court’s judgments that are perceived as indirect interventions in the legislative process, assessing the legal consequences of this gradual shift toward a positive legislative function.
Constitutional courts are intended to review the constitutionality of legal norms, whose primary purpose and the raison d'être is to safeguard against potential harms arising from majoritarian democracy. This function ensures that norms conflicting with constitutional provisions are annulled, which traditionally defines constitutional courts as negative legislators. When the Constitutional Court was established in Türkiye, it was designed not only to annul unconstitutional provisions but also to implicitly serve the aim of limiting political authority in order to safeguard the continuity of the constitutional system. This design has sparked considerable debate regarding the Court’s evolving role, with several of its judgments indicating a gradual move from the negative legislator to a de facto positive legislator.
